Please read these Terms & Conditions carefully before accessing or using EventKernel, a product operated by HighKernel. By registering, accessing, or using EventKernel, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with these terms, you must not use the platform.

Acceptance of Terms

These Terms & Conditions constitute a legally binding agreement between you and HighKernel, the operator of EventKernel. By creating an account, accessing, or using EventKernel, you confirm that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy.

About EventKernel

EventKernel is an online event management and ticketing platform that provides technology and infrastructure for:

  • Event Hosts: To create and manage events, configure ticket types, collect registrations, manage attendees, and receive ticket-related payments.
  • Attendees: To discover events, register for events, purchase tickets, and access booking and ticket information.

EventKernel primarily acts as a technology platform and intermediary between event hosts and attendees. Unless explicitly stated otherwise, EventKernel does not organize, host, sponsor, or independently guarantee the quality, safety, legality, accuracy, or successful completion of events created by third-party event hosts.

User Eligibility

  • You must provide accurate and complete information when creating an account or using EventKernel.
  • Users must meet the minimum age requirements applicable to their use of the platform and relevant transactions.
  • Where required by applicable law, users under the age of 18 may require parental or legal guardian involvement.
  • Users entering into paid transactions must meet the applicable legal requirements for those transactions.
  • Event hosts are responsible for ensuring that their events comply with applicable age restrictions and other legal requirements.

Ticket Purchases & Payment

Ticket Booking

When you purchase a ticket through EventKernel, the ticket purchase is generally a transaction between the attendee and the relevant event host. EventKernel facilitates the technology and payment process but is not generally a party to the underlying agreement between the event host and attendee.

Payment Gateway

Payments for EventKernel transactions are processed through Razorpay or another payment provider supported by EventKernel. Depending on the payment method and checkout flow, users may be required to accept the applicable terms and privacy practices of the payment provider. EventKernel does not store sensitive payment credentials such as full card numbers, CVV/CVC, UPI PINs, or online banking credentials.

Platform Fee

EventKernel may charge a platform or service fee on applicable transactions. Where applicable, the fee will be clearly displayed before the payment is completed. The refundability of platform fees will depend on the applicable transaction, refund policy, and applicable law.

Pricing

Prices are generally displayed in Indian Rupees (INR) unless otherwise stated. Applicable taxes, platform fees, or other charges will be displayed where required or applicable.

Payment Methods

Available payment methods may include UPI, credit and debit cards, net banking, wallets, and other payment methods supported by the applicable payment provider. The availability of specific payment methods may vary.

Cancellations & Refunds

Attendee Refunds

Refund eligibility depends on the refund and cancellation policy established by the relevant event host and displayed during the booking process. Attendees should review the applicable refund policy before purchasing a ticket.

Event Cancellation by Host

If an event is cancelled by the event host, the event host is responsible for fulfilling applicable refund obligations to attendees in accordance with the event's stated refund policy and applicable law.

Event Mismanagement or Dissatisfaction

In cases involving event mismanagement, failure to provide the advertised event or services, material changes to the event, or dissatisfaction arising from the event itself, the relevant event host is responsible for addressing the attendee's claim and fulfilling any applicable refund, compensation, or other financial obligation. EventKernel may assist with communication, transaction records, or payment-related processes where appropriate, but does not generally assume the event host's underlying obligations.

Refund Processing

Approved refunds will generally be processed through the original payment method or another payment mechanism supported by the applicable payment provider. The time required for a refund to appear may vary depending on the payment provider, bank, card network, or other financial institution involved.

Event Host Obligations

If you use EventKernel as an event host, you agree to:

  • Provide accurate and complete information about your events, including dates, times, venues, descriptions, ticket pricing, and applicable restrictions.
  • Maintain accurate ticket availability and honour valid ticket bookings.
  • Provide the event, services, or experience represented to attendees.
  • Establish and clearly communicate appropriate cancellation and refund policies.
  • Respond appropriately to attendee queries relating to your event.
  • Comply with all applicable laws, regulations, permits, licensing requirements, and venue requirements.
  • Not use EventKernel to create, promote, or operate fraudulent, misleading, unlawful, or deceptive events.
  • Respect the intellectual-property, privacy, and other rights of attendees and third parties.
  • Pay applicable platform fees and other charges agreed with EventKernel.
  • Use attendee information obtained through EventKernel only for legitimate and lawful event-related purposes.

Event hosts are solely responsible for the organization, management, conduct, safety, legality, delivery, cancellation, and fulfilment of their events, including applicable attendee refunds or compensation arising from the event. EventKernel may restrict, suspend, or remove an event or host account where we reasonably believe these Terms or applicable laws have been violated.

Attendee Responsibilities

As an attendee, you agree to:

  • Provide accurate information when registering or purchasing tickets.
  • Review event details, ticket conditions, refund policies, and applicable restrictions before completing a purchase.
  • Use tickets only in accordance with the applicable event and platform rules.
  • Not use EventKernel to commit fraud, abuse payment systems, or interfere with the platform.
  • Follow reasonable event, venue, safety, and entry requirements established by the event host.
  • Not misuse, duplicate, alter, or fraudulently reproduce tickets.

Prohibited Activities

You agree not to:

  • Use EventKernel for fraudulent, deceptive, unlawful, or harmful purposes.
  • Create or promote fraudulent, misleading, or unauthorized events.
  • Impersonate another person, organization, event host, or entity.
  • Attempt to circumvent EventKernel's payment, authentication, or security mechanisms.
  • Exploit pricing, payment, technical, or system errors.
  • Use bots, scrapers, automated systems, or other methods to abuse or disrupt the platform.
  • Attempt unauthorized access to EventKernel accounts, systems, APIs, or infrastructure.
  • Upload malicious software or harmful content.
  • Violate intellectual-property, privacy, or other rights of third parties.
  • Sell, transfer, or resell tickets outside EventKernel where such activity is prohibited by the applicable event or platform rules.
  • Use EventKernel in violation of applicable laws or regulations.

Intellectual Property & User Content

EventKernel and its underlying software, interface, branding, logos, designs, text, graphics, and other original materials are owned by or licensed to HighKernel and are protected by applicable intellectual-property laws. You may not copy, reproduce, modify, distribute, reverse engineer, or commercially exploit EventKernel or its proprietary materials without appropriate authorization.

User-Submitted Content

When you upload or submit content to EventKernel, including event descriptions, banners, images, logos, and other event materials, you retain ownership of your content. However, you grant HighKernel a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and provide EventKernel services. You represent that you have the necessary rights and permissions to submit the content and that the content does not unlawfully infringe the rights of others. HighKernel may remove, restrict, or disable access to content that violates these Terms, applicable law, or third-party rights.

Platform Availability

We aim to keep EventKernel available, secure, and reliable, but we do not guarantee that the platform will always be uninterrupted, error-free, or available. EventKernel may temporarily suspend or restrict access for maintenance and system upgrades, security updates or investigations, technical issues, abuse and fraud prevention, legal or regulatory requirements, or circumstances beyond our reasonable control.

Account Suspension & Termination

HighKernel may suspend, restrict, or terminate an account, event, transaction, or access to EventKernel where we reasonably believe that these Terms have been violated, the platform is being used fraudulently or unlawfully, the account or event creates a security or safety risk, required information is inaccurate or incomplete, continued access could harm EventKernel or its users, or suspension is required by applicable law. Where appropriate and legally permitted, we may provide notice before taking such action. Suspension or termination does not automatically release a user from obligations that arose before the suspension or termination.

Third-Party Services

EventKernel may integrate with or provide access to third-party services, including payment, authentication, hosting, communication, and media services. Third-party services may operate under their own terms, privacy policies, and conditions. HighKernel does not control third-party services and, to the extent permitted by applicable law, is not responsible for their independent operation, availability, policies, or practices.

Disclaimer & Limitation of Liability

EventKernel provides technology and infrastructure that enables event hosts and attendees to interact through the platform. To the maximum extent permitted by applicable law, HighKernel does not guarantee or assume responsibility for the acts, omissions, conduct, cancellation, content, quality, safety, legality, or performance of events organized by third-party event hosts. To the maximum extent permitted by applicable law, HighKernel shall not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of EventKernel. The aggregate liability of HighKernel arising from a claim related to EventKernel shall not exceed the amount actually paid by the claimant to HighKernel for the relevant service or transaction during the three months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless HighKernel, its affiliates, and their respective personnel from claims, losses, liabilities, damages, and reasonable expenses arising from their violation of these Terms, their misuse of EventKernel, their violation of applicable laws or regulations, content they submit to EventKernel, events they create or organize, or their infringement of third-party rights. This provision does not apply to the extent that the relevant claim results from HighKernel's own unlawful conduct or liability that cannot legally be excluded.

Changes to Terms

HighKernel may update these Terms from time to time to reflect changes to EventKernel, our services, technology, business practices, or applicable legal requirements. Where significant changes are made, we may provide notice through the EventKernel platform, email, or another appropriate communication channel. The updated Terms will include a revised Last Updated date. Continued use of EventKernel after the updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
